Five Steps to Use a Collection Agency to Collect Debt
Here are the steps on how to use a collection agency to collect debt:
Five Steps to Follow
- Choose a reputable collection agency. Ask for referrals from friends, family, or business associates. You can also check with the Better Business Bureau (BBB) or the Consumer Financial Protection Bureau (CFPB) for complaints against the agency.
- Provide the agency with all the necessary information. This includes the debtor’s name, address, phone number, and the amount owed. You may also need a copy of the original invoice or contract.
- Set clear expectations with the agency. Confirm how they’ll operate, what fees they’ll charge, and agree on a timeline for collecting the debt.
- Monitor the collection process. Stay in contact with the agency and track their progress. If you’re not satisfied, you can always switch to a different agency.
- Get a written agreement from the debtor. Once the debt is paid, get written confirmation that it’s paid in full. This protects you if the debtor disputes it later.
Here are some things to keep in mind when using a collection agency:
What to Keep in Mind
- Debt collectors are subject to federal regulations. The Fair Debt Collection Practices Act (FDCPA) sets rules for how debt collectors can communicate with debtors. For example, they cannot harass, threaten, or abuse debtors, or lie about the debt or their legal authority to collect it.
- You have rights as a debtor, too. The FDCPA gives you the right to dispute the debt and the right to be free from harassment. If a debt collector violates your rights, you can file a complaint with the CFPB.
Using a collection agency can be a helpful way to collect unpaid debts. However, choose a reputable agency and understand your rights as a debtor before you start.
